Municipality of Helmond: registering the ending of a civil partnership in the civil registry
To end a registered partnership, you will go to a notary or lawyer. In some cases, you have to go to court with your lawyer. The registered partnership is not terminated until it is entered in the registers of civil status.
A registered partnership also ends if:
- You have the registered partnership converted into a marriage
- One of the partners passes away
- One of the partners goes missing for a long time
The notary or lawyer sends your request to the municipality where the partnership is registered. Only after registering the request in the registers of the civil registry is your partnership terminated.
The conditions for ending a registered partnership through a notary or lawyer are:
- You have no children under the age of 18.
- You both want to end the registered partnership.
Do you have children under the age of 18? Or you do not agree on the termination of the partnership or on the arrangements? Then you must go to court. You will need a lawyer for this.
This is how you end a registered partnership through a notary or lawyer:
- You go to a notary or lawyer.
- Together, you draw up an agreement on ending the partnership.
- The notary or lawyer reports the agreement to the municipality.
- The agreement is registered by the municipality in the registers of civil status.
Do you have to have the registered partnership terminated through the courts? Look for the steps at Rechtspraak.nl (in Dutch).
Registration of the ending of a civil partnership is free of charge.
The agreement (via notary or lawyer) must be registered with the civil registry within 3 months. A court ruling must be registered with the civil registry within 6 months.
You can appeal the court's order.
