Province of Zuid-Holland: compensation for damages with a groundwater extraction or water infiltration permit
Your permit to abstract groundwater or to infiltrate water may be withdrawn or amended. If you have suffered or will suffer damage as a result, you may receive compensation. You may also receive compensation if your permit is partially withdrawn. The condition is that the consequences of the amendment or the withdrawal of the permit should not be borne by you. Who awards the compensation depends on how the permit was amended or withdrawn.
The eligibility conditions for compensation include: You are the holder of a permit to abstract groundwater or to infiltrate water. Your permit has been withdrawn in whole or in part, or the its conditions have been amended. As a result of this amendment or withdrawal, you have suffered or will suffer damage. The damage should not be borne by you.
You should apply for compensation with the province that made the decision to amend or withdraw the permit. This does not apply if the decision relates to a provincial plan. In that case, the Minister for Infrastructure and Water Management adopts the amendment. The Minister may also adopt an amendment under the Wet milieubeheer (Environmental Management Act).
