Province of Noord-Holland: applying for compensation for damage arising from the removal of earth

If you have incurred losses as a result of a permit to excavate soil being granted, revoked or amended, you may be eligible for compensation. You can request compensation through the provincial authorities or, if this involves removal of sediment (dredging) in national waters, from the Ministry of Infrastructure and Water Management.

You can request compensation in the following cases:

  • You have applied for an earth removal permit.
  • You are the holder of a permit.
  • You have submitted your objections to an earth removal permit.
  • You have suffered damage as a result of an earth removal permit. This applies both for damage you have suffered in the past and for damage you will suffer in the future as a result of an earth removal permit.
  • It is not reasonable for you to have to suffer the damage, either in whole or in part.
  • The damage is not covered, or is insufficiently covered, by other means.

This is how you request compensation:

  • Go to the online Omgevingsloket (in Dutch). This is the service counter for environmental and planning permits.

  • Do the permit check.

  • Log in.

  • You can submit your request by completing the e-form.

  • If necessary, add attachments to your application.

You apply to the province for compensation. This is the province that made the decision on the earth removal permit.

Did the Minister for Infrastructure and Water Management make the decision? In that case, you should apply for compensation with them.

If you have applied for a permit, in most cases the regular process applies. In this case you will receive the decision within 4 months from the date we received your application.

If you have applied for a permit, your application could go through one of two processes, as described below.

Regular process

  • If you do not agree with our decision on your application, you can lodge an objection. You will need to do this within 6 weeks of the decision.
  • If you disagree with the decision on your objection, you can lodge an appeal with the court within 6 weeks.
