Municipality of Oosterhout: applying for a planning permit

Do you want to build, renovate, demolish, create a driveway, cut down a tree in your garden, or make other changes to your surroundings? First, complete a Permit Check through the Environmental Desk. You'll need DigiD (residents) or eHerkenning (business owners) for the Permit Check.

Procedure

The municipality checks whether your application:

  • complies with the regulations of the Buildings and Living Environment Decree (Bbl);
  • is in line with the environmental plan. This municipal plan stipulates what may be done with a piece of land or a building;
  • is in line with the building aesthetic regulations. With these regulations, the municipality determines how buildings may look, for example, their shape or color.

Do you have a complex application, for example, does your renovation not comply with the environmental plan, or are you applying for multiple permits for a single project? Then your municipality can ask stakeholders such as neighbors and residents for their opinion.

The cost of an environmental permit depends on the activity. You can calculate the costs using the fee table in the current building fees ordinance. This is a standard document that lists the fees. If you need an environmental permit because you are planning to build something, you will need the construction costs to calculate the costs.

The municipality must usually decide within eight weeks whether you will receive the permit. If it's a complex application, the municipality will decide within six months. The municipality may extend the decision period by another six weeks.

The municipality of Oosterhout's announcements (such as permits granted) are published weekly in the Oosterhout Weekly. The municipality's generally binding regulations (bylaws) are published in the electronic municipal gazette. You can object to some municipal decisions. If an objection is possible, this is indicated in the decision. You must file an objection within six weeks. The decision you received will state who you can contact.

Conditions  

The most important conditions for filing an objection to a decision are:

  • the decision is in writing;
  • the decision is made by the municipality;
  • you have a direct interest in the decision.

Submitting a Written Objection  

Your letter must include the following:

  • your name and address;
  • the decision you are objecting to;
  • the reason for your objection;
  • the date of the objection;
  • your signature.

Submitting an Objection Digitally

You can also submit an objection digitally. To do so, use the online Objection Submission form. You will need DigiD (residents) or eHerkenning (businesses) for this.

Deadline
You must submit your objection to the municipality within six weeks. The decision on the objection will be made within six weeks (twelve weeks for an Advisory Committee) from the day after the deadline for submitting the objection expires. This deadline can be extended by a maximum of six weeks.

Note: You cannot submit a (digital) objection if the decision concerns a spatial planning procedure (draft zoning plan or zoning plan procedure), as this is not legally possible.
