Province of Overijssel: applying for a temporarily tolerated violation of provincial environmental regulations
If you are unable to comply with one or more provisions of our Provincial Environmental Regulation (omgevingsverordening), you can in some cases ask us to make an exception or to grant a temporary dispensation.
You can apply for a temporary exemption permit if the following conditions are met:
- There is an exceptional situation, for example a situation of force majeure or a transitional situation.
- A complete application for a permit or exemption has been submitted to the municipality. In addition, there is a good chance that the permit or exemption will be granted.
- The applicant should submit the application for a permit or exemption in time.
- There are good reasons for the temporary exemption.
- The activity can take place responsibly.
- The interests of third parties are not harmed.
- You must provide written proof of the importance of the application. This interest must outweigh the importance of strictly enforcing the environmental rules.
- As a business, you will draw up a written declaration stating your willingness to comply with the agreements made.
You apply for the temporary exemption permit with the province.
