Province of Gelderland: applying for a temporarily tolerated violation of provincial environmental regulations

In exceptional situations you can apply for a temporary exemption order for activities covered by the Environmental Law (General Provisions) Act (Wabo). There must be a transitional situation and/or a trial. This is included in the Gelderland tolerance policy rules 2018. A temporary exemption order is a decision not to take action against the activity during a certain period.

You can apply for a temporary exemption order if you meet the following conditions: 

  • You have submitted a complete application for a permit or an exemption. Furthermore, it is likely that we will grant the permit or exemption. 
  • You submitted the application for a permit or exemption in time. 
  • The activity can and will be carried out in a responsible manner. 
  • The interests of third parties are not harmed. 
  • You can prove the importance of the application in writing. This importance outweighs the importance of strict enforcement of the environmental regulations. 

If the Government has announced to amend national legislation as a result of which a permit requirement ends, situations may occur in which applying for a temporary exemption order will not be necessary.
